U.S.-Based Immigration Attorney Lawyer Aba, a Ghanaian immigration attorney based in the United States, has provided an important update on recent immigration policies, particularly concerning birthright citizenship and the actions of certain U.S. states.

According to Lawyer Aba, President Donald Trump has attempted to change the interpretation of the U.S. Constitution regarding birthright citizenship. His administration issued an executive order stating that children born in the U.S. to undocumented immigrants would not automatically be granted American citizenship. However, this move faced widespread legal resistance.

Several state mayors and legal bodies issued nationwide injunctions against the executive order, arguing that it was unconstitutional. As it stands, birthright citizenship remains in effect. The injunctions were designed to block the enforcement of the executive order across the entire country, not just in individual states.

Lawyer Aba emphasized that 28 states still have the option to return to court to challenge the order. However, it is important to note that an executive order cannot override the U.S. Constitution. She anticipates that more court activity will occur within the next 30 days regarding this issue.

For immigrants living in the 28 states covered by the injunctions—especially if they move into the 22 states where the injunctions are actively enforced—their U.S.-born children still qualify for American citizenship
