Lawyer Juliana Berko Reveals Immigration Updates in Spain

International lawyer Juliana Berko, a Ghanaian-born legal expert based in Spain, shared important insights in an interview with DJ Nyaami on SVTV Africa’s Daily Hustle Worldwide show.

In the detailed discussion, she revealed that the Spanish government has introduced new immigration policies. One significant update concerns the NIE (Número de Identificación de Extranjero) process. Previously, immigrants had to wait three years before applying for residency, but the waiting period has now been reduced to two years. The government has also made adjustments to the application process, aiming to make it more flexible.

Juliana mentioned that Valencia recently experienced severe flooding. The Spanish government has announced that victims without proper residency documents (NIE) will still receive assistance. However, only those residing in Valencia will qualify.

Residency and Legalization Process

According to her, if an immigrant enters Spain through irregular means (by land or air) and overstays their visa without an NIE, they will be considered illegal. However, Spain offers a pathway to legalization. Individuals who have stayed in the country for two years can apply for residency through a legal process, which involves Spanish language courses and proper documentation.

Moreover, foreigners married to or in a relationship with Spanish citizens can apply for residency. Additionally, Spain provides opportunities for education—immigrants can study and work at the same time, provided they have proof of two years of stay. Students pursuing a degree will automatically receive a four-year visa, simplifying the process.

Asylum Seekers and Work Opportunities

Juliana also touched on asylum seekers, explaining that those whose applications are denied will have their waiting period for residency counted from the day of rejection. The Spanish government is open to welcoming immigrants, but employment opportunities remain limited, with most jobs available in sectors that require foreign workers.

Changes in Immigration Policies

Over the past five years, Spain has eased some immigration policies but is expected to introduce stricter regulations soon, similar to the UK’s tightening of immigration laws. A job-seeking visa has also been introduced, requiring applicants to provide proof of funds before entry.

She advised Ghanaians planning to migrate to be well-prepared and ensure they follow legal procedures. Those without an NIE should avoid engaging in criminal activities, as it could lead to immediate deportation.
